Building conditions on a contract of sale!

Even if you tick the boxes with conditions on the contract given to you by the Selling Real estate agent you are still long way away from being safe.

Standard wording in a common contract of sale

Building inspection condition.

“The contract is conditional upon the buyer/s obtaining at their expense a written report from an independent registered builder or qualified structural engineer, certifying that the dwelling on the property is structurally sound within 14 days of acceptance of this contract.

If the report discloses that the dwelling is not structurally sound, the buyer/s may at the buyer’s option, terminate this contract by written notice, supported by a copy of the report, to the vendor within 24 hours of receipt of the report.”

There are two major details you should notice in that text.

First is that you need a Registered Builder (or Engineer) to write the Building Inspection Report for you.

And second, that you must buy the property unless it has a major structural defect. Most properties are structurally sound, but they could still be a mess and very expensive to fix. By accepting standard close like this, you essentially surrender your building inspection condition.

The property may have asbestos, stumps in need of replacement, underfloor flooding, inadequate ventilation, windows in need of replacement, corroded gutters, blocked drainages leading to excessive flooding of foundations and more serious structural problems and many other items that need repair. But unfortunately you won’t be able to withdraw your offer if you have accepted a standard Building Inspection clause.
